1. Introduction

These Terms of Service ("Terms") govern your use of the website beyondenigmatic.com ("Website") and any consulting services provided by Enigmatic OÜ, trading as Beyond Enigmatic ("we", "us", "our").

By accessing our Website or engaging our services, you agree to be bound by these Terms. If you do not agree, please do not use the Website or engage our services.

3. Website use

Permitted use

You may use our Website for its intended purposes: learning about our services, completing the Startup Growth Diagnostic, booking consultations, and accessing resources we make available.

Prohibited use

You may not:

• Use the Website in any way that is unlawful, fraudulent, or harmful

• Attempt to gain unauthorised access to our systems or data

• Scrape, data-mine, or systematically extract content from the Website

• Use the Website to transmit unsolicited marketing or spam

• Reproduce, redistribute, or commercially exploit our content without written permission

4. Startup Growth Diagnostic

The Startup Growth Diagnostic is a free, self-serve assessment tool. Results are generated algorithmically based on your responses and are intended as general guidance only.

• Diagnostic results do not constitute professional advice, a guarantee of outcomes, or a commitment to provide services.

• Results are personalised to your inputs but are not a substitute for a professional audit or consultation.

• We may update the diagnostic questions, scoring methodology, or recommendations at any time.

5. Consulting services

Engagement

Consulting services are provided under a separate Statement of Work (SOW) or engagement agreement. These Terms apply in addition to any project-specific agreement. In the event of a conflict, the project-specific agreement takes precedence.

Scope of work

The scope, timeline, deliverables, and fees for each engagement are defined in the relevant SOW or proposal. Work outside the agreed scope requires mutual written agreement.

Payment

• Payment terms are specified in each engagement agreement.

• Invoices are payable within the period stated (typically 14 days).

• Late payments may incur interest at the rate permitted under Estonian law.

• We reserve the right to pause work on overdue accounts.

Partner network

We may engage trusted third-party specialists (developers, marketers, etc.) to deliver parts of an engagement. When we do, we remain accountable for the quality and coordination of their work. Partner involvement will be communicated to you in advance.

6. Intellectual property

Our content

All content on the Website — including text, design, graphics, diagnostic tools, frameworks, and resources — is owned by Enigmatic OÜ or its licensors and is protected by copyright and other intellectual property laws.

Client deliverables

Upon full payment, intellectual property in custom deliverables (designs, strategy documents, etc.) transfers to you as specified in the engagement agreement. We retain the right to use anonymised examples of our work for portfolio and marketing purposes unless agreed otherwise.

Pre-existing IP

Frameworks, templates, tools, and methodologies that we bring to an engagement remain our intellectual property. You receive a licence to use them for your business.

7. Limitation of liability

To the maximum extent permitted by law:

• Our total liability for any claim arising from our services shall not exceed the fees paid for the relevant engagement.

• We are not liable for indirect, consequential, or incidental damages, including lost revenue, lost data, or lost business opportunities.

• Diagnostic results and general resources are provided "as is" without warranty of any kind.

Nothing in these Terms excludes or limits liability for fraud, death, or personal injury caused by negligence, or any other liability that cannot be excluded under applicable law.

8. Confidentiality

Both parties agree to keep confidential any proprietary information shared during an engagement. This includes business strategies, product data, metrics, and financial information. This obligation survives termination of the engagement for a period of 2 years.

9. Termination

Either party may terminate a consulting engagement with 14 days' written notice. Upon termination, you are liable for fees for work already completed. We will deliver any work in progress in its current state.

We reserve the right to suspend or terminate Website access for users who violate these Terms.

10. Disclaimers

While we strive to provide high-quality services and accurate information:

• We do not guarantee specific business outcomes, revenue increases, or conversion improvements.

• Past results (including case studies) are illustrative and do not guarantee future performance.

• Our advice is professional opinion based on our experience and methodology, not a guarantee.

11. Third-party links

Our Website may contain links to third-party sites. We are not responsible for the content, privacy practices, or availability of those sites.

12. Governing law and disputes

These Terms are governed by the laws of the Republic of Estonia. Any disputes shall first be resolved through good-faith negotiation. If negotiation fails, disputes shall be settled by the courts of Tallinn, Estonia.

13. Changes to these Terms

We may update these Terms from time to time. Continued use of the Website after changes constitutes acceptance. We will make reasonable efforts to notify users of material changes.
